Terms of Service

1. Agreement to Terms

By accessing or using Archer, a trading assistant service operated by Tristero Research, Inc. ("Tristero," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Description of Service

Archer is an AI-powered trading assistant that helps users execute cryptocurrency trades, manage digital wallets, and access market information. The service is accessible via:

• Supported messaging platforms, including Telegram, Signal, iMessage/SMS, WhatsApp, Discord, Slack, and email, where available
• Web interface

3. Eligibility

You must be at least 18 years old and legally permitted to use cryptocurrency services in your jurisdiction to use Archer. By using our service, you represent and warrant that you meet these requirements.

4. Account Registration

When you register with Archer, we may create a digital wallet on your behalf. You are responsible for:

• Maintaining the security of your account credentials
• Using only accounts and wallets you own or are authorized to operate
• Notifying us immediately of any unauthorized access

5. Messaging, Digests, and Notifications

Archer may send responses to your requests, account and transaction notices, and optional digests or product updates. Promotional messaging is subject to applicable consent requirements and your preferences. Accepting these Terms or joining a group is not a substitute for any separately required marketing consent.

• Message frequency varies with your requests, subscriptions, and settings
• Message and data rates may apply depending on your carrier or provider
• To request an SMS opt-out, reply STOP; for other channels, use the available unsubscribe controls or contact support@tristero.com
• You can request an opt-out from all marketing messages, and can contact support for help
• Stopping messages does not itself cancel a submitted trade, an authorized automation, or your account

Delivery depends on third-party platforms, carriers, and network availability. Messages may be delayed, duplicated, arrive out of order, or fail to arrive. A queued or provider-accepted message is not proof that a recipient read it or that a trade executed. Check the order, wallet, exchange, or transaction record before relying on execution status or resubmitting a request. Notifications are not an emergency service.

6. Cryptocurrency and Trading

Risk Disclosure: Cryptocurrency trading involves substantial risk of loss. Prices are highly volatile and can fluctuate significantly in short periods.

• AI-generated commentary and market summaries are informational and are not a substitute for advice from a qualified financial, investment, legal, or tax professional
• You are solely responsible for your trading decisions
• Past performance does not guarantee future results
• Only trade with funds you can afford to lose
• Transactions on blockchain networks are irreversible

AI responses and third-party news, quotes, charts, or summaries may be inaccurate, incomplete, or stale. They do not guarantee a price, return, execution, or investment outcome. Verify material information before acting. These Terms do not determine whether an activity requires regulatory authorization or remove any duties that apply to Archer under law.

Your Instructions and Authorizations

Review the account, asset, network, amount, price limits, fees, and other details presented before approving an action. Authorization applies to the action or automation you approve, within its stated scope; a general conversation or group membership does not authorize transactions from another person's wallet. Do not bypass required confirmations. An enabled automation may act under its existing authorization until stopped or expired. A cancellation request may arrive after submission and cannot reverse a confirmed blockchain transaction. Prices, liquidity, fees, slippage, and network conditions may change during execution.

7. Wallet Services

Archer may create and manage cryptocurrency wallets on your behalf. You acknowledge that:

• Managed wallet keys are stored in encrypted form; Archer systems can access them for wallet operations, and encryption does not eliminate all risk
• You are responsible for any assets deposited to your wallet
• Blockchain network issues, smart contract vulnerabilities, protocol failures, and compromised credentials can cause loss of assets
• Supported networks include Ethereum, Bitcoin, Solana, and other EVM-compatible chains

8. Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Engage in market manipulation, wash trading, or fraudulent activities
• Attempt to circumvent security measures or access unauthorized systems
• Use the service to launder money or finance terrorism
• Impersonate others or provide false information
• Abuse, harass, or send spam through our messaging systems

9. Intellectual Property

Archer's software, branding, and original service content are owned by Tristero Research, Inc. or its licensors and are protected by applicable intellectual property laws. You retain your rights in content you submit. You grant us permission to process that content as needed to provide the service you request, subject to our Privacy Policy and applicable law. Third-party content remains subject to its owners' rights. We do not guarantee that AI-generated output is unique or free of third-party rights.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRISTERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR CRYPTOCURRENCY ASSETS.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Mandatory consumer rights and any applicable statutory or regulatory duties remain in force. The disclaimers above apply only to the extent permitted in your jurisdiction.

12. Indemnification

You agree to indemnify and hold harmless Tristero and its officers, directors, employees, and agents from third-party claims, damages, losses, or reasonable expenses caused by your unlawful use of the service, violation of another person's rights, or material breach of these Terms, to the extent permitted by law. This obligation does not apply to the extent a claim results from our own misconduct or breach of legal duties.

13. Termination

We may terminate or suspend your access to the service at any time, without prior notice, for any reason, including violation of these Terms. Suspension does not transfer ownership of your assets to Tristero. Contact support@tristero.com for withdrawal or account-access assistance following suspension or termination. Withdrawals remain subject to applicable law, required identity or security checks, and network availability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions, except where mandatory local law provides otherwise. You may contact legal@tristero.com to raise a dispute. This does not require you to give up any right to seek relief from a court or regulator, and does not postpone an applicable filing deadline.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the service or by other means. Where applicable law requires renewed acceptance, we will request it. Updated Terms do not replace any separately required consent for marketing or a materially different use of personal information.
